TERMS & CONDITIONS
PAYMENTS

Initial Payment:

A non-refundable 50% down payment is due at the time of booking. The remaining balance is not due until approval of the cover itself, with the exception of the blurb and page count. NO files will be sent until payment is made in full.

Final Payment:

Final payment is due within 7 days of the final invoice being sent. A 5% late fee will be added for each additional week that payment isn’t made. If an invoice is not paid for more than 90 days, an additional $100 fee will be applied.

Rush Order Requests:

TRC Designs can occasionally fit a rush project into schedule. A rush project, with less than a week turn around, will be a $100.00 added fee. A rush project, with a two week, or longer, turn around, will be a $80.00 added fee.

Pre-made Purchases:

Pre-made sales are final. There are no refunds or exchanges. Payment is due up front, as pre-made covers are first come, first serve.

TIME FRAMES

Initial Proofs:

TRC Designs will send 1-2 starting proofs, unless otherwise discussed.

Changes to Proofs:

There is an allowance of 10 changes TOTAL that may be made to the cover after the initial proofs. Each additional change will be $15. This may include, but may not be limited to, font changes, color changes, image mood changes, mix and match of proofs, etc.

Changes to images:

If the main cover image changes after work has begun, there will be an additional $50 charge, per image change regardless of who provides the image.

Time frame:

Please try to book your cover as soon as possible and well ahead of any scheduled deadlines. Each additional change will take extra time on TRC Designs part to complete and delay the completion of the final artwork. TRC Designs is not responsible for missed deadlines on the Client’s end due to additional changes.

Changes after approval:

The client understands that the image MAY NOT be altered by anyone except Cat of TRC Designs, in whole or in part. The client also understands that additional charges may apply for any alterations after approval and/or after final files are sent. Changes after the final files are sent will begin at $45 and may increase with the number of files that need to be altered.

Pre-made Designs:

Premade design proofs will be sent to client within 7 days of filling out the premade design form, regardless of if the month is booked with custom work.

DESIGN SERVICES

Prices are subject to change at any time, and without warning. Price is only guaranteed upon receipt of deposit.

With cover packages, the following is included, unless stipulated:

eBook file suited for all platforms
Paperback, high resolution JPG, PDF wrap
Digital Delivery of the files
Additional extras may be included depending on the cover package chosen.
IMAGE EXPENSES

Stock Images:

The Client provides the MAIN cover image. This ensures that they maintain the rights to said image. Details, such as flourishes, small extra images, and certain back images, are included in the cover design package and will not be the Client’s responsibility. The Client must obtain the correct rights and permissions for use of the photo they are providing. Client agrees to indemnify and hold harmless TRC Designs from any and all copyright and permission infringement action resulting from materials client provides.

TRC Designs Photo:

Image chosen will be removed from TRC Designs library. TRC Designs maintains full rights to this photo, Client maintains limited rights to use this photo for anything involving the Client’s book promotion, alone. While this image will be pulled from my library, similar images may remain from that same photo shoot. This keeps your price as low as possible. Variations in the angle of the image will still be available. Which images get removed from the set are up to TRC Designs discretion. Images that are almost exact will be removed.

Photo may NOT be sold, reused, or used out of context aside from the specified book related printing, reproductions, and otherwise. It may be used for any print promotion, and online promotional use. It may not be used for sale items other than the eBook, and print book. If other sale items will be created from this photo, the Client will need to purchase the full rights to the image.

Photo may not be used on any other printed work by alternate designers, unless otherwise discussed. TRC Designs, and the Client maintain rights to the specified photo.

Each image shall not, under any circumstances, be altered without prior permission by TRC Designs.

CANCELLATION

In the event of a cancellation before work has started, no further expenses will be owed. If the work has begun on the project, the remaining balance will be owed. Once work is booked, no refund will be given.

OWNERSHIP OF ARTWORK

TRC Designs maintains full rights of all original artwork. Artwork AND CONCEPT, including layout, image style, placement, and fonts may NOT be recreated by another person (Client OR alternate artist included).

The Client maintains the rights to the stock photo that they have downloaded. If a custom photo shoot is done for the Client, the Client maintains limited rights to the images used on their covers. Those images may ONLY be used for promotion of their book. The cover itself can be used for merchandising.

The client understands that the any image MAY NOT be altered by anyone except TRC Designs, in whole or in part. The client also understands that additional charges may apply for any alterations after approval and/or after final files are sent.

TRC Designs always maintains the limited rights to the cover to use as any sort of self-promotion, portfolio, client viewing, etc.

ATTRIBUTION

TRC Designs requires that design credit in the form of “Cover Design by Cat of TRC Designs” in the clients eBook and paperback copy. eBook files have the option to be linked to TRC Designs Facebook page and/or website, but it is not required.

LIABILITY

TRC Designs is not liable for damages of any kind, including loss of revenues, profits, business, reputation, or data, in any way related to our services. TRC Designs is not responsible for any claim, loss, or injury based on errors or inaccuracies appearing on our site or in our clients’ written documents once the cover has been approved.

Should TRC Designs take longer to complete the project than originally indicated i.e. family emergency, act of nature, the Client will be contacted via phone or email in order to agree upon a new project completion date.

CODE OF FAIR PRACTICE

TRC Designs acknowledges that to the best of his/her knowledge, the work prepared is an original creation and has not been previously published and/or consent to use has been obtained on an unlimited basis. The work prepared does not contain any scandalous, libelous, or unlawful matter. The Client and/or others may not use TRC Designs product in any way that may infringe upon the rights of others.

ACCEPTION OF TERMS

Both TRC Designs and the Client will acknowledge acceptance of these terms. By acknowledging this contract, the Client agrees to hold TRC Designs entirely free from any liability, including financial.
